You'll need to clarify some things. First, how are you powering your robot arm? What gears are you using? Have you tried other gear ratios to increase torque?

Manufacturing LEGO-compatible items does not open you to litigation. Manufacturing patented items would. Considering that most of LEGO's patents expired, especially on their basic bricks, that shouldn't be a problem. As long as you don't infringe the LEGO trademark, you would be fine.

If you are just going for something aesthetically close, and not load bearing, why do you need the hinge piece on the top? Just push the long hinge plate up in to the "awning" and then your problems are solved.

If you are referring more specifically to the pen mechanism, you are looking for a bistable cam system. You can, of course, also search for pen mechanism, which gave me lots of pretty pictures from Google.

The technical name for what you're looking for is a latched push button. You might try latching instead of latched, and you might try switch instead of push button, but switch will also give you a lot of toggle switch results, which isn't what you want.
